Effective Defense Against Serious Allegations

Violent cases are not only taken extremely seriously by law enforcement and prosecutors, but they capture the imaginations of the jury and the public. These cases require careful navigation at every stage, from discovery and jury selection to final arguments. At Portale Randazzo LLP, our team not only includes a former assistant district attorney but also has an incredibly high success rate in the courtroom.

We can represent you in the following types of criminal cases:

"What Could the Penalties Be?"

The penalties for a violent crime are steep. Although they range in severity, a conviction could result in incarceration, large fines, community service, and civil penalties. For instance, criminally negligent homicide, which occurs when someone engages in conduct without perceiving the associated risks and causes the death of another, is a class E felony. Being found guilty of the offense results in a prison sentence of up to 4 years and/or a fine of up to $5,000. Second-degree murder, which is the intentional killing of another, is a class A-I felony. Depending on the circumstances, it can be penalized by up to life imprisonment.

Violent sex crimes can also have life-altering consequences that can last long after the sentence is complete. People convicted of these offenses are required to register as sex offenders. New York has a three-level sex offender classification system, with Level 1 being the lowest and Level 3 being the highest. The length of time a person must register depends on the level they’re in: Level 1, 20 years; Levels 2 and 3, life. The registration requirement is in addition to the prison sentence and fine the court imposed upon conviction.

Individuals convicted of violent crimes might also suffer collateral consequences – disabilities and sanctions that aren’t imposed by the court but can substantially affect a person’s life. For instance, if someone is convicted of a felony, they may lose their right to possess a gun. Additionally, a conviction will show up on the individual’s criminal record, which anyone can access. Thus, when the person is seeking a job or housing, the decision-maker may be adversely influenced by what they find in the individual’s history.

Having a ruined reputation because of a criminal past and being unable to obtain gainful employment or a place to live can make re-entry into society difficult. Therefore, it’s necessary to retain the services of a lawyer and aggressively fight your charge immediately. Our mission as White Plains violent crime defense attorneys is to reduce the charges against you whenever possible and minimize the impact these allegations may have on your life.
