Wrongful “drug kingpin” conviction overturned (NYC): The conviction of our client, Elvis Moreno, was dismissed in 2021, and he was released from prison. Mr. Moreno was wrongfully labeled a drug kingpin based on being an innocent passenger in a car where a drug transaction occurred. He had been sentenced to seven years in prison despite having a clean record. We successfully fought his wrongful conviction, making him a free man.

Federal 235-month sentence overturned (DC Circuit Court of Appeals: Our client was serving this sentence in federal prison for an alleged multi-state conspiracy to possess and distribute PCP between New York and Washington, D.C. After Attorney Portale submitted legal briefs and delivered oral arguments, the case was remanded to the District Court and ultimately dismissed, and the client was released. 

Understanding New York’s Major Extent Trafficking Charges

New York law penalizes large-scale drug operations under the Operating as a Major Trafficker statute (New York Penal Law § 220.77)

Operating as a Major Trafficker (The "Kingpin" Statute)

New York enforces exceptionally harsh penalties for individuals alleged to be directors or organizers of a narcotics network. You can be indicted under the Major Trafficker statute if the state alleges you acted as a director of a controlled substance organization and:

  • The total proceeds from the drug sales within a period of 12 months or less equal $75,000 or more; or
  • You knowingly and unlawfully possessed with the intent to sell narcotics with an aggregate value of $75,000 or more within a six-month window.

What Are the Consequences?

Operating as a Major Trafficker is a Class A-I felony in New York, which is the highest classification of a crime in the state penal law. A conviction carries a mandatory minimum sentence of 15 to 25 years to life in state prison, along with huge financial fines and the immediate civil seizure and forfeiture of all your bank accounts, real estate, and personal property.
